1. Introduction

DataSpark Tech LLC ("DataSpark Tech," "we," "us," or "our") provides custom software, IT, and artificial intelligence services. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit datasparktech.com (the "Site"), submit a form, apply for a position, or otherwise engage with us. By accessing or using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the terms of this policy, please do not access or use the Site.

We may offer our services to individuals and businesses located both within and outside the United States. This policy is designed to give a clear, comprehensive account of our practices regardless of where you are located, but it is governed by United States and Texas law as described in Section 15.

2.1 Information you provide directly

  • Contact and inquiry information: name, email address, phone number, company name, and the details you submit through our "Start a project" form, including service of interest, estimated budget, and timeline.
  • Application information: if you apply for a position through our Careers/Apply page, we collect your name, email, phone number, LinkedIn profile URL, the role you're applying for, a link to your resume, and any additional information you choose to share.
  • Correspondence: any information you provide when you email us directly or otherwise communicate with us.

2.2 Information collected automatically

Like most websites, our hosting and infrastructure providers may automatically log limited technical information such as IP address, browser type, device type, referring pages, and general usage patterns, for security and operational purposes. 3. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and provide quotes, proposals, and information about our services;
  • Evaluate and process job applications;
  • Communicate with you about your project, engagement, or application;
  • Operate, maintain, secure, and improve the Site and our services;
  • Enforce our Terms of Service and other agreements;
  • Comply with applicable legal obligations; and
  • Protect the rights, property, and safety of DataSpark Tech LLC, our clients, and others.

We do not sell your personal information to third parties.

We do not sell, rent, or trade your personal information. We may share information in the following limited circumstances:

  • Service providers. We use third-party vendors to operate the Site and process form submissions, currently including Web3Forms (form-to-email delivery) and Google Fonts (typography delivery via CDN). These providers process data only as necessary to provide their service to us.
  • Legal compliance. We may disclose information where required to comply with applicable law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of DataSpark Tech LLC, our personnel, clients, or others.
  • Business transfers. If DataSpark Tech LLC is involved in a merger, acquisition, financing, or sale of business assets, information may be transferred as part of that transaction, subject to standard confidentiality arrangements.

6. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, including maintaining business records, responding to inquiries, evaluating repeat or delayed engagements, complying with legal obligations, resolving disputes, and enforcing our agreements. Where no specific retention period is legally mandated, we determine retention periods based on the nature of the information, the purpose for which it was collected, and our legitimate business needs. We reserve sole discretion to determine appropriate retention periods consistent with this policy.

DataSpark Tech LLC is based in the United States, and our team and infrastructure providers may be located in the United States, India, and other jurisdictions. If you are located outside the United States, please be aware that information you provide to us may be transferred to, stored, and processed in the United States and other countries whose data protection laws may differ from, and may be less protective than, those of your home jurisdiction. By using the Site or submitting information to us, you consent to this transfer, storage, and processing.

Depending on your location, you may have rights regarding your personal information, which may include the right to request access to, correction of, or deletion of your personal information; to object to or restrict certain processing; and to request a copy of your information in a portable format. To exercise any of these rights, contact us using the details in Section 16. We will respond to legitimate requests within a reasonable timeframe and consistent with applicable law. We may decline requests that are unfounded, excessive, or that we are not legally required to honor, and we may need to verify your identity before fulfilling a request.

Our Site's use of cookies and similar technologies is described in full in our Cookie Policy. In summary, the Site currently does not use analytics or advertising cookies; we may introduce such technologies in the future, at which point this policy and our Cookie Policy will be updated accordingly.

10. Children's Privacy

The Site is not directed to, and is not intended for use by, individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take reasonable steps to delete such information promptly. If you believe a child has provided us with personal information, please contact us using the details in Section 16.

11. Data Security

We take reasonable administrative and technical measures designed to protect information submitted to us. However, no method of transmission over the internet, and no method of electronic storage, is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot and do not guarantee its absolute security, and you acknowledge and accept this risk by submitting information to us. To the fullest extent permitted by applicable law, DataSpark Tech LLC disclaims liability for any unauthorized access to, or use, alteration, or destruction of, your submitted information, except where such liability cannot be excluded under applicable law.

12. Third-Party Links

The Site may contain links to third-party websites, including social media platforms and resume/portfolio hosting services referenced in job applications. We are not responsible for the privacy practices or content of any third-party sites. We encourage you to review the privacy policies of any third-party site you visit.

13. Changes to This Policy

We may update this Privacy Policy from time to time at our sole discretion. Changes take effect immediately upon posting to the Site, with the "Last updated" date revised accordingly. We are under no obligation to provide individual notice of changes. Your continued use of the Site after changes are posted constitutes acceptance of the revised policy. We encourage you to review this page periodically.

14. Limitation of Liability

To the fullest extent permitted by applicable law, DataSpark Tech LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or related to this Privacy Policy or your use of the Site, even if advised of the possibility of such damages. Nothing in this policy is intended to limit any rights you may have that cannot be limited or excluded under applicable law.

15. Governing Law & Disputes

This Privacy Policy is governed by, and construed in accordance with, the laws of the State of Texas, United States, without regard to its conflict-of-law principles, and, where applicable, the laws of the United States. Any dispute, claim, or controversy arising out of or relating to this Privacy Policy shall be resolved through the dispute resolution process described in our Terms of Service, including its arbitration and venue provisions, to the extent permitted by applicable law.
